Challenging the decision, Mohanty had moved the high court in 2013. "Though the high court has quashed the compulsory retirement decision, my client cannot be reinstated in service as his due date for retirement was in May 2017. As an administrative decision, the full bench of high court in April 2012 had recommended compulsory retirement for Subhendra Mohanty , who then worked as district judge in Boudh, after examining his performance.
