“Serious Lapse”: Show cause notice to Health Secy over Moosewala’s Family IVF treatment

A significant controversy has erupted in Punjab following the recent IVF treatment controversy surrounding late Punjabi singer Sidhu Moosewalas family. Just days after Sidhu Moosewalas 58-year-old mother gave birth to a baby boy through IVF treatment, the Punjab Government has taken a stern stance, issuing a show cause notice to the states Principal Health Secretary Ajoy Sharma.   The notice, issued on Thursday, sought an explanation as to why the Health Secretary failed to inform either the Health Minister or the Chief Minister about the sensitive issue. In the show cause notice, the Government highlighted a serious lapse on the part of the Health Secretary, emphasizing that he was required to bring the matter to the attention of both the Minister-in-charge and the Chief Minister, in accordance with the Rules of Business, 1992. Failure to do so, the notice stated, constituted grounds for disciplinary action under the All India Services (Discipline and Appeal) Rules, 1969.   In light of provisions of Rules of Business, 1992 and given the significance of the issue involved, you were required to bring it to the notice of your Minister-in-charge and Honble chief minister and take their orders regarding further course of action, read the notice.   Asking the Health Secretary to reply to the show cause notice within two weeks, the notice stated, This is a serious lapse on your part. Hence, you are asked to show cause within two weeks as to why proceedings under the All India Services (Discipline and Appeal) Rules, 1969 should not be initiated against you.   Punjab Governments move came in response to allegations of harassment leveled by Moosewalas father, Balkaur Singh, who accused the government of making rounds to question the newborns legitimacy as per the Central Governments letter. Balkaur Singh voiced his grievances on Facebook, expressing distress over the Governments interference in connection with the birth of his second child.   The controversy was erupted after the Union Ministry of Health and Family Welfare sought a report from Punjab regarding the In Vitro Fertilization (IVF) administered to Sidhu Moosewalas mother, Charan Kaur, under the Assisted Reproductive Technology (Regulation) Act, 2021. The Act stipulates specific age limits for women undergoing ART procedures, raising questions about the legality of the treatment.   The Centre has asked the state of Punjab to submit the report to the Department. Under Section 21(g) (i) of the Assisted Reproductive Technology (Regulation) Act, 2021, the age limit prescribed for a woman going under ART Services is between 21 and 50 years. At the time of birth, Charan Kaur was 58 years.   The controversy surrounding the IVF treatment administered to Charan Kaur, Sidhu Moosewalas mother, has reignited discussions on reproductive rights and the ethical implications of assisted reproductive technologies. Critics argue that the birth of Moosewalas younger sibling at the age of 58 raises questions about the appropriateness of IVF treatment for older women and the potential risks involved.   Parents of the late Punjabi singer Sidhu Moosewala, Balkaur Singh, and Charan Kaur welcomed a baby boy on Sunday, almost two years after the killing of the singer in Punjab. In a video posted on Facebook, Moosewalas father, Balkaur Singh said that he was harassed by the state government in connection with the birth of his second child. …the Government is now troubling me asking me to prove his legal status…I want to request the CM (Bhagwant Mann) that please let me get the treatment done with, then I will come wherever the government calls me, he said in a video posted on social media.
