(File photo) The Gujarat High Court has asked the Gujarat Cancer and Research Institute (GCRI) to refund the additional fees of Rs one lakh per term for three years (total six terms) to students who enrolled themselves in the postgraduate multi-specialty course. The order came from Justice K M Thaker last month. In 2011, when the petitioners went to GCRI to join the institute, they were told that they would be required to pay Rs 1,00,000 per term for 3 years (two terms in each year) to the GCRI over and above the fees fixed by the B J Medical College and Gujarat University. GCRI is a joint venture of Gujarat Cancer Society and Government of Gujarat. The petitioners had objected to the “unjust” demand. The GCRI had stated that “if the said amount is not deposited by the petitioners, Joining Reports would not be prepared and admissions would be cancelled”. Being constrained, the petitioners had deposited Rs 1,00,000 additional fee over and above the legitimate fees to be paid by them. Thereafter, Joining Reports were prepared. The court observed that the petitioners, who have paid Rs 1 lakh fees to respondent No.4 GCRI) were entitled to refund. The order said the petitioners should submit demand-note for refund with proof of identity. “After scrutiny of such evidence (identity), the respondent No. 4 (GCRI) shall return said additional fees to the petitioners within 4 weeks from the date of receipt of the demand note”. Dr P M Shah, the then GCRI director, said, “The objective of GCRI at that time was to retain students in Gujarat. I am yet to see the judgment for further comment”.
