HC cancels bail of former MLA in gang rape case

The applicant alleged that after grant of bail, the accused did not appear before the trial court. The girl was drugged and moved to many places, and in the meantime she was gang raped by MLA and other accused.Allowing the bail cancellation application moved by the father of the rape survivor, Justice Sudhir Agarwal observed, “Even after five years since former MLA was released on bail, the trial of the case could not be completed. It was only when in March 2014, the high court directed high-ranking police officers of the state to either appear before the court or arrest the accused, the accused surrendered before the court below and was granted bail by the court within three days. Allahabad: Taking serious note of misuse of bail by former MLA Tajendra Sagar alias Yogendra Sagar, who is accused in gang rape of a girl student, Allahabad High Court on Monday cancelled his bail and directed him to surrender before the police by April 1, failing which he shall be immediately arrested.An FIR was registered at Bilsi police station of Badaun against Sagar in connection with the gang rape of the girl student in 2008.

Allahabad: Taking serious note of misuse of bail by former MLA Tajendra Sagar alias Yogendra Sagar, who is accused in gang rape of a girl student, Allahabad High Court on Monday cancelled his bail and directed him to surrender before the police by April 1, failing which he shall be immediately arrested.An FIR was registered at Bilsi police station of Badaun against Sagar in connection with the gang rape of the girl student in 2008. It is alleged in the FIR that on April 23, 2008, when the survivor girl was on her way to appear in BA examination, she was forcefully taken into a car by the then MLA with the help of one Neeraj Sharma. The girl was drugged and moved to many places, and in the meantime she was gang raped by MLA and other accused.Allowing the bail cancellation application moved by the father of the rape survivor, Justice Sudhir Agarwal observed, “Even after five years since former MLA was released on bail, the trial of the case could not be completed. It is a fit case of misuse of bail and also that bail granted to MLA deserves to be cancelled.”The bail cancellation application states that after passing of a considerable long period after the case of gang rape, Sagar surrendered in May 2014 and was granted bail within three days of his surrender. As a result, the trial of the criminal case registered against him was still pending.After going through the record, the court found that despite non-bailable warrant (NBW) issued by the court since many years, the accused remained at large and police could not arrest him. It was only when in March 2014, the high court directed high-ranking police officers of the state to either appear before the court or arrest the accused, the accused surrendered before the court below and was granted bail by the court within three days.
