ALLAHABAD: Allahabad High Court on Wednesday stayed the arrest of SP leader Azam Khan, his wife Tazeen Fatima and son Abdullah Azam Khan in connection with a criminal case registered against them, alleging that Abdullah got his two fake date of birth certificates issued through fraudulent means from two different places.In an FIR lodged by a BJP leader Akash Saxena at Ganj police station of Rampur on January 3, 2019, it was alleged that Azam Khan and his wife helped their son to obtain two fake date of birth certificates — one from Lucknow and another from Rampur.He alleged that these certificates were used for getting passport, PAN card and also foreign trips. The FIR was lodged under section 420 (cheating and dishonestly inducing delivery of property), 467 (forgery of valuable security, will etc), and 468 (forgery for purpose of cheating) of Indian Penal Code (IPC).Appearing on behalf of the petitioners, their counsel Imran Ullah contended that the FIR was lodged due to political vendetta with ulterior motives. He further contended that since no loss or gain was made to anybody, no case of cheating is made out against petitioners Azam, his wife and son.Further, a complaint, if any, could be made only by the officer who had registered their date of births. Hence the complainant, Akash Saxena, has no locus (right to file a case) in the said matter. However, the state counsel opposed the plea saying that a prima facie case is made out against them.
