Wrong products: E-commerce firm to pay Rs 7,000

It was submitted that the complainant received complete refund against one of the products, which was not mentioned by the complainant. Consulting Rooms stated in its reply that being a reseller, it delivered the product to the complainant, as it was received from the manufacturer in a sealed box. It was also stated that these sellers are separate entities being controlled and managed by different persons/ stakeholders. CHANDIGARH: The district consumer disputes redressel forum has directed Myntra Designs and Consulting Rooms Private Limited to Pay Rs 7,000 compensation for delivering the wrong products ordered through their website.The complainant, Aditya Sharma of Sector 49, stated in his complaint that he had ordered three items and paid Rs 1,966, Rs 2,294 and Rs1,186 for each one of them respectively. It was stated that there was no privity of contract with the complainant as they only act as an intermediary through their web interface and provide a medium to various sellers to interact.

CHANDIGARH: The district consumer disputes redressel forum has directed Myntra Designs and Consulting Rooms Private Limited to Pay Rs 7,000 compensation for delivering the wrong products ordered through their website.The complainant, Aditya Sharma of Sector 49, stated in his complaint that he had ordered three items and paid Rs 1,966, Rs 2,294 and Rs1,186 for each one of them respectively. However, on receipt of the delivery , the complainant was shocked to see that the items delivered were totally different from the ones ordered.The complainant then sent an email to Myntra in this regard, in response to which, the latter assured to update him regarding the return within two business days, but surprisingly, after few days, the company sent a new email flatly refusing to replace the wrong products. Calling the said act and conduct deficiency in service and unfair trade practice, he filed a consumer complaint.Myntra in its reply stated that the goods in question had been bought by the complainant from the independent third-party seller selling its product on the website. It was stated that there was no privity of contract with the complainant as they only act as an intermediary through their web interface and provide a medium to various sellers to interact. It was also stated that these sellers are separate entities being controlled and managed by different persons/ stakeholders. It is stated that they are not engaged in sale of any goods manufactured or produced by its own, rather it is engaged in selling of goods manufactured and produced by others.The forum after hearing both sides held that “the perusal of tax/ retail invoice suggests that Myntra and Consulting Rooms Limited are not only providing a platform to the intending sellers for booking of the order for goods which are made available on their website, but goods are also delivered and collected back by them in case of return. The consumer(s) place order with them with a hope that they will get good bargain and better products, but their faith shatters when they are not provided with better quality products and sometimes are delivered with the products other than the products ordered.”Forum held that the firm cannot escape from their liability stating that they are not the manufacturer of the product and only provide a portal for sale, because they allow the companies to project their products for sale on their portal, so it is their legal obligation to keep a check for the rightful delivery of the products.”
