The assertion came as Justice Manoj Bajaj dismissed the plea for protection with Rs 25000 costs. After going through the averments Justice Bajaj observed a girl and two boys were born from her wedlock. After hearing the counsel for the petitioners Justice Bajaj asserted the court found that the petitioner was already married and had entered into a relationship without dissolution of marriage. Justice Bajaj added the petitioner-woman has entered into an unholy alliance with the petitioner-widower and the petition was based on bald averments without any supportive material.

Tribune News Service Chandigarh January 29 The Punjab and Haryana High Court has asserted that a mother of three who left her husband to live with another man without dissolution of her marriage entered into an “unholy alliance”. The assertion came as Justice Manoj Bajaj dismissed the plea for protection with Rs 25000 costs. Taking up the matter Justice Bajaj asserted the petitioners were praying for directions to the official respondents to protect their life and liberty and further for restraining some other respondents from interfering in their peaceful life. After going through the averments Justice Bajaj observed a girl and two boys were born from her wedlock. But for the past six months she came in contact with another person — a widower without a child from his marriage. The petitioners fell in love. But the private respondents turned against their alliance when their relationship came to their knowledge. They then decided to live together. The petitioners were however apprehending that the private respondents would cause harm to them. As such they submitted a representation to a senior police functionary. But action was not taken resulting in the filing of the writ petition. After hearing the counsel for the petitioners Justice Bajaj asserted the court found that the petitioner was already married and had entered into a relationship without dissolution of marriage. The representation submitted by them lacked material particulars. Even the manner and mode of alleged threat extended to the petitioners had not been mentioned. Justice Bajaj added the petitioner-woman has entered into an unholy alliance with the petitioner-widower and the petition was based on bald averments without any supportive material. “Since the petitioners have filed this petition without a valid and convincing cause of action the petitioners deserve to be burdened with costs. In view of this the Court does not find any reason to exercise the extraordinary writ jurisdiction and the petition is dismissed with costs of Rs 25000 to be deposited with the District Legal Services Authority” Justice Bajaj concluded.
