Petition against flag masts in public places

The petitioner had claimed that a majority of the flag masts had been erected on encroached land. The Madras High Court has sought the response of the State government to a public interest litigation petition filed by a party-in-person, A. Radhakrishnan, to ban erection of flag masts of political parties in public places such as pavements, parks, playgrounds and roadsides. Apart from posing hindrance to smooth flow of traffic on the road, the erection of such flag masts also leads to damage caused to roads and telecommunication cables laid underground. Muralidaran ordered court notices returnable by two weeks on the PIL petition pending in the court since 2016. He accused the officials of turning a blind eye to the practice, an offence under the Tamil Nadu Property (Prevention of Damage and Loss) Act of 1992.
