Madras HC: Actor Suriya’s NEET remark not contempt but ‘’unnecessary’

The Madras HC remarks came after actor Suriya condemned court in a tweet for delivering justice through video conference due to fear of coronavirus but ordered students to write NEET exams fearlessly.

Film star Suriya Sivakumar will not face contempt case over his tweet against the conduct of NEET exams that also criticized judiciary. The Madras High Court on Friday declined to initiate contempt proceeding against the cine star for his comments on Supreme Court’s decision to allow the National Eligibility Cum Entrance Test (NEET) midst pandemic.

The court stated ‘’ it would be prudent on the part of individual to carefully frame their minds and express themselves that may not cross the borders of nay fair and just criticism. On the other hand it not job of a constitutional Court to use sledgehammer for avoidance of something which can be perceived to be not capable of even being propped up as contempt, much less debated to the level of a criminal contempt. This matter therefore in our judicious discretion does not deserve to be pursued further and we entirely agree with opinions expressed by the Advocate General’’.

The court also stated that right to freedom of speech to call a spade a spade and to exercise free unrestrained are two different dimensions. It added that the right to freedom of speech that includes fair criticism is guaranteed under the Indian Constitution but the same Constitution also protects judicial governance from insidious and derogatory remarks.

The court further added ‘’the utterances by the cine actor are unnecessary and unwarranted for being ignorant of manner in which the entire judiciary of this state has served the interest of its citizens has been serving during pandemic’’.

On September 13 cine actor Suriya issued a statement following the alleged suicide of three NEET aspirants in Tamil Nadu, he criticized court’s decision for ordering students to write NEET exams. This statement however offended Justice SM Subramaniam of Madras HC who sought to initiate contempt of court against Suriya and wrote a letter to CJ AP Sahi seeking for contempt proceedings. Various retired judges and leaders of both the opposition have voiced out their opinions.
