Can't order full-time governor for Tamil Nadu, says Madras high court

CHENNAI: Madras high court on Saturday rejected a PIL seeking a direction to the Centre to appoint a 'full-time' governor for Tamil Nadu, saying there was no provision in the Constitution for one person being governor of more than one state, and that court's interference in such matters was not warranted. "The appointment of a governor is in the realm of the powers of the office of the President of India. "Article 153 of the Constitution provides that there shall be a governor for each state. However, in view of the proviso to Article 153 of the Constitution the interference of the court is not warranted," the bench said. The proviso makes it clear that nothing in that Article shall prevent the appointment of the same person as governor for two or more states," said the first bench of Chief Justice Indira Banerjee and Justice M Sundar.The PIL filed by V Anbazhagan said that after the retirement of K Rosaiah as governor of Tamil Nadu on August 31, 2016, governor of Maharashtra Ch Vidyasagar Rao has been given additional charge as Tamil Nadu governor The bench said that neither the PIL nor documents appended thereto whispered about how and in what manner had the executive functions of Tamil Nadu been impaired by the appointment of Ch Vidyasar Rao as governor of the state.
