Gated community residents reply to Corporation notice

Shruthi Enclave Welfare Association has responded to the notice sent by the Coimbatore Corporation to its members asking them to stop construction of buildings and respond to its notice, failing which the civic body warned of demolishing the unauthorised constructions. And, with the Court permission, the Association had also impleaded the builder as a party.

In its response of September 20, the Association said the promoter of the group housing scheme had obtained the Directorate of Town and Country Planning permission on August 23, 2004 and the Local Planning Authority’s permission on September 14, 2009 for construction 137 group houses. The promoter had constructed 107 houses and all its members had bought the houses. At the time of the purchase, the DTCP’s and LPA’s permissions were in force. A few owners of lands in the vicinity had lodged a complaint with the DTCP, based on which it withdrew on August 28, 2017 the technical permission it had given. And based on that withdrawal, the LPA too cancelled its planning permission the next day. The Association said it had challenged the withdrawal of the permission and the Madras High Court could post the matter any time soon for final hearing. And, with the Court permission, the Association had also impleaded the builder as a party. At this stage, the Corporation could not say it was unauthorised construction, the Association has said.
