Supreme Court asks Koraput gangrape victim brother to move Orissa HC

CUTTACK: Supreme Court on Friday directed brother of the minor tribal girl, who was allegedly gangraped in Koraput in October last year and later committed suicide in January, to file his plea seeking CBI probe into the entire incident in Orissa high court.“During hearing of the case, the state government’s counsel apprised the Supreme Court that at least four similar petitions praying for CBI probe into the Koraput gangrape and suicide incident are pending in Orissa high court. In its October 16 dated report, the forensic laboratory mentioned about the presence of semen on the recovered garments of the girl, however, surprisingly in the October 23 report it denied presence of any semen.The petitioner had urged that only a CBI probe can unravel the truth behind the entire incident and ensure justice to his sister. He had also contended in the writ petition that malafide and ill-motivated investigation by the police caused grave and immeasurable damage to the minor as a result of which she took the extreme step to end her life.The petitioner also cited that the state machinery tried its best to manipulate the medical evidence in the case as it was evident from the fact that the state forensic laboratory submitted two contradictory reports. Taking note of it, division bench of Justices Adarsh Goel and UU Lalit asked us to file our plea in the high court,” said petitioner’s counsel, Sarthak Nayak.“If we are unsatisfied with the high court’s order that we will again move Supreme Court for justice,” added Nayak.Brother of the 15 year old tribal girl has alleged that he has no faith on the investigation of the state police and wants an independent inquiry into the incident from the alleged gang-rape to the suicide of her sister.The petitioner had alleged that all attempts were made by state police to sabotage the investigation process.
