7 get jail term for implicating UT businessman in rape case

Later, after finding that the facts mentioned by the complainant Ajay was true, the police had to drop section 328, 376, and 506 in the FIR. Both then left for Hansi where they met Mahima’s husband at a resort when some policemen arrived.The policemen accused Ajay of kidnapping and raping Mahima and forced him to reach a compromise in lieu of Rs 20 crore. He said in the complaint that the woman visited their showroom on April 26, 2012, and introduced herself as some Mrs Hooda and expressed interest in purchasing a land. An amount of Rs 4 crore was transferred from Ajay’s account to Sonu Bansal’s account via RTGS on May 4, 2012.Investigation revealed that the money was shared by several persons.

YAMUNANAGAR: Yamunanagar deputy district attorney Sanjeev Kumar said additional sessions judge Dr Abdul Majid had awarded seven-year rigorous imprisonment each to seven accused, including two policemen, for extorting Rs 4 crore from a Chandigarh-based businessman, who was implicated in rape case The court has also fined Rs 3.97 lakh on Mahender Singh of Bhiwani, Mahavir Singh of Jind, Varun Gupta of Yamunanagar, Karambir of Jind, Mahima Kadiyan alias Mahima Hooda of Rohtak, Ram Niwas of Jind, and Sunil Dutta of Saharanpur, Uttar Pradesh.The accused have been sentenced under Sections 120B, 211, 327, 342, 388, 420, and 506 of the IPC. The court has also sentenced separate rigorous imprisonment to the main accused, Mahima, under Section 419 of the IPC.The main accused in the case are Sonu Bansal and Mahima Kadiyan. Sonu Bansal has been declared as a proclaimed offender and has not been arrested so far.In May 2012, in her complaint, Mahima Kadiyan of Rohtak, alleged that she was raped in a hotel in Yamunanagar after she consumed soft drink, which was laced with sedative by Ajay Bansal, proprietor of Kala Emporium Private Limited, Chandigarh.On Mahima’s complaint, the police booked Ajay under Section 328 (causing hurt by means of poison, etc, with intent to commit offence), 376 (punishment for rape), and 506 (punishment for criminal intimidation) of the Indian Penal Code (IPC).The complainant claimed that on May 12, 2012, Mahima and her brother went to Yamunanagar along with Ajay for some property deal.A counter complaint was lodged by Ajay’s uncle Jai Chand stating they had been doing business with Sonu Bansal of Yamunanagar since 2010. He said in the complaint that the woman visited their showroom on April 26, 2012, and introduced herself as some Mrs Hooda and expressed interest in purchasing a land. Later, on April 27, 2012, she was shown a 172-acre site at Dhanaura village and a deal was settled for Rs 30 crore.Chand in his complaint further added that on May 2, 2012, Ajay and Mahima went to Bilaspur tehsildar office in Yamunanagar for some documents related to the said land, but the documents were not available with the patwari.Later, they went to some hotel in Yamunanagar and the same day at 4pm, Mahima told Ajay that her husband was in Hansi with the earnest money for the property. Both then left for Hansi where they met Mahima’s husband at a resort when some policemen arrived.The policemen accused Ajay of kidnapping and raping Mahima and forced him to reach a compromise in lieu of Rs 20 crore.
