Gurugram court rejects bail application of Ryan School officials

GURUGRAM: In the murder case of Pradhyumn Thakur of Rayan International School, Gurugram court rejected bail application of Francis Thomas and Jayesh Thomas on Monday. As per the guidelines, children toilet should have lady attendant and there should be separate toilet for school staff. "Due to negligence of school management, the child was exposed to accused in a vulnerable situation," argued prosecutor before court. While public prosecutor stressed that negligence on the part of school management is very clear, it is cognisable offence. Accused were produced before court without submitting case file leading to adjournment.

GURUGRAM: In the murder case of Pradhyumn Thakur of Rayan International School, Gurugram court rejected bail application of Francis Thomas and Jayesh Thomas on Monday. Along with the prime accused Ashok Kumar, bus conductor, Francis and Jayesh were sent into judicial custody till September 29.The court pulled up police for laxity in dealing with the court proceeding of the case. Accused were produced before court without submitting case file leading to adjournment. Even public prosecutors were briefed at the last moment. The court proceedings which started at 10.45 am finally ended at 5pm after three adjournments.North India head of Ryan Internal School Francis Thomas and HR head of Bhondsi campus applied for bail through Advocate DC Gupta in the court of additional session judge Rajni Yadav. The bail application was opposed by public prosecutors Anurag Hooda and Arvind Sharma saying chief minister Manohar Lal Khattar has announced to hand over the case to the CBI. Central agency will be re-investigating the case, so granting bail to school officials would not be appropriate at this time as they can tamper with the evidence and influence witnesses.Prime accused Ashok Kumar, who had not applied for the bail, pleaded innocence before the court. Retracting from his earlier statement (given before media) in which he had confessed to the crime, Ashok claimed to have not killed Pradhyumn and accused police of torture.Gupta, who was representing Francis and Jayesh, argued that his client was not responsible for the unfortunate incident and argued that Francis and Jayesh are covered under provision of section 75 of JJ Act which is bailable. While public prosecutor stressed that negligence on the part of school management is very clear, it is cognisable offence."Due to negligence of school management, the child was exposed to accused in a vulnerable situation," argued prosecutor before court. Highlighting the report of deputy commissioner regarding deficiencies in infrastructure and security measures, public prosecutor said school was not having sufficient CCTV, no camera was installed before toilet, quality of CCTV was very poor, unsafe construction of toilet in which incident happened and others.The school management was also accused of violating safety guidelines uploaded on Gurugram police website. As per the guidelines, children toilet should have lady attendant and there should be separate toilet for school staff.
