Consumer forum awards two-year jail to builder

A consumer forum has awarded two-year imprisonment to Gharonda Builders and Developers managing partner Sunil J. Sachdev for not complying with a previous judgment. The forum also directed Sachdev to pay ?10,000 as compensation. The forum was dealing with a complaint filed by J. Aparnaji (33) and T. Prem Kalyan (34), both hailing from Bengaluru. He later requested the forum to take a lenient view on account of his age. This was done after the complainants said a flat in Gharonda Chamundeshwari Apartments in Musheerabad was not handed over to them.

The complainants said the company had not complied with a judgment dated September 23, 2015, in which the forum had directed the respondent to pay compensation of ?1 lakh, punitive damages of ?5,000 per month from April 26, 2013, and litigation costs of ?2,000. This was done after the complainants said a flat in Gharonda Chamundeshwari Apartments in Musheerabad was not handed over to them. The respondent said he was not in a position to pay the compensation and that there is no ‘wilful defiance’ on his part with respect to the complaint. He later requested the forum to take a lenient view on account of his age. “There is no clinching evidence on record to show that there are specific orders in force prohibiting execution of sale deed in respect of Flat No.406, in the absence of which it cannot be said that the respondent is incapable of complying the orders, dated 23.09.2015, for the reasons beyond his control,” the judgment reads. The forum also directed Sachdev to pay ?10,000 as compensation.
