As per the Act, part of land will be used for urban infrastructure development with the consent of the landowner under the Land Pooling Scheme, instead of the UDH acquiring the land.Sources at UDH said, apart from this, two more bills related to (UDH) that were passed in the state assembly during the previous BJP’s tenure continue to remain only on paper.The Rajasthan Urban Land (Certification of Titles) Act, 2016 was passed by the Rajasthan assembly on April 4, 2016 for the first time in the country with an aim to curb fraudulent practices in sale and purchase of non-agricultural land in urban areas by issuing a certificate of ownership for a nominal fee.The previous government had claimed that the bill would give clear titles to urban land owners and would reduce litigations in court. However, the bill was not passed as rules are not framed till date. Sources at the UDH said, “If the bill was implemented residents could have sought certificate of title to claim ownership of their non-agricultural lands falling in urban areas - those governed by the municipalities or the development authorities - by paying a nominal fee to the state government. It is voluntary for the owners to apply for these certificates.”Similarly, Apartment Ownership and Urban Land (Certification of Titles) could not be implemented in absence of rules.
