HC contempt notice to CS over Masala Chowk

The chatwallas aggrieved by this order, filed an SLP before the Apex Court. They have also given licenses to many such other persons by settling them in an area developed by the JDA by the name " Masala Chowk ".JDA had complete knowledge about existence of prohibitory orders and inter–departmental communications warning JDA against undertaking any commercial activity, support the contention put–forth by petitioner that the action of establishing Masala Chowk in the Ram Niwas Garden is a deliberate act of violating order of January 19 2010. The supreme court dismissed this SLP in 2010.The authorities partially complied by removing the ‘Chatwalas & Hawkers’ from the garden premises as also cafeteria and other eateries were shifted or re-located.However, the petitioner said contemnors have not only permitted commercial activity within the park area but have even re-settled the chaatwallas who had been shifted out of the park. Jaipur: Rajasthan High Court on Tuesday issued contempt notice to chief secretary, principal secretaries of UDH, tourism, art and culture, PWD, commissioner JMC and JDA on noncompliance of its order on Ram Niwas Bagh by constructing food court named ‘Masala Chowk’.The division bench of chief Justice Pradeep Nadrajog and G R Moolchandani issued the notice on a petition by Ashwini Tiwari.The petitioner said that following a PIL, the high court gave several directions to the state government in 1993 to preserve the famous Ram Niwas garden including regulation of traffic through the park.The high court modified the order of 1993 by another order in 1997 to the extent that light motor vehicles having Pollution Control Board certificate may pass through the garden between 8 am to 9 pm till an alternative road is proposed and prepared to connect J.L Nehru Marg with the other side of the city for vehicular traffic.The court also directed that chatwallas which were about 27-30 in number, were to be accommodated in the kiosks at different places in the city.
