Court turns down rape survivor’s plea to abort

Jodhpur: Rajasthan High Court on Thursday declined to allow termination of pregnancy of a minor rape victim. "On Thursday, the report was produced in the court, which stated that the foetus is 26 weeks and the girl is anaemic. After this, a complaint of rape was given to the police on June 19. The doctor had then revealed to the mother that the girl was pregnant.Shocked mother, when inquired, was told by the victim that she was raped by one Rahul. On the complaint, police had arrested Rahul, who on investigation, turned out to be Naushad.

Jodhpur: Rajasthan High Court on Thursday declined to allow termination of pregnancy of a minor rape victim. Girl had moved a petition in the court seeking permission for termination of pregnancy after which the court had sought a medical report.The report was produced in the court on Thursday which said that the health of the victim was not fit for termination of pregnancy and if proceeded, may become a threat to her life.After perusal of the report, Justice Vijay Bishnoi refused to give permission of termination of pregnancy to the girl and listed the matter of hearing on July 24."Since the petition seeking termination of pregnancy is decided, now we will proceed for demanding appropriate compensation or maintenance for the victim," said her counsel Gokulesh Bohra.Bohra said that since the girl's family is very poor and not willing to go ahead with pregnancy, they were interested in termination of the pregnancy but after the refusal of the court to grant permission, it will be important to see that how the family will take this decision and birth of the child.The pregnancy of the girl had come to the notice of her mother in June when she had taken the victim to the doctor on complaint of stomach pain. The doctor had then revealed to the mother that the girl was pregnant.Shocked mother, when inquired, was told by the victim that she was raped by one Rahul. After this, a complaint of rape was given to the police on June 19. On the complaint, police had arrested Rahul, who on investigation, turned out to be Naushad. A case has been registered under appropriate sections against him, including POCSO Act.Later, the girl moved a petition in the high court for termination of pregnancy, allowing which Justice Bishnoi had sought a medical report by a medical board to ascertain the possibility of the termination."On Thursday, the report was produced in the court, which stated that the foetus is 26 weeks and the girl is anaemic. In such condition, the procedure of termination would be quite risky and may pose threat to her life," said the AAG Shiv Kumar Vyas.Going by this report, the court finally refused to allow the termination of pregnancy and listed the matter of hearing on July 24 for determining compensation to the victim and also the repercussion arising out of the birth of the child.
