Forum imposes Rs 50,000 fine on fuel dealer for adulteration

KOCHI: To caution those who sell adulterated petrol and diesel at fuel pumps, Ernakulam Consumer Disputes Redressal Forum has imposed a fine of Rs 50,000 on a petroleum dealer at Muvattupuzha.The forum imposed fine on Bharat Petroleum (BP) for the offence committed by their dealer who filled adulterated fuel in the car of Bindhu George at Muvattupuzha in May 2017.As per the complaint by George, she filled diesel in her car from a retail outlet of BP at Muvattupuzha for Rs 1,000. After filling the fuel, the complainant’s husband, who was driving the car felt missing in the engine. The engine stopped after they travelled around 3 km. The car was later taken to the service centre of the manufacturer.On examination, the complainant was informed that the reason for missing was due to the usage of adulterated fuel. Therefore, the fuel tank was emptied and refilled for Rs 1,000. Bindhu had to replace injection pump assembly by spending Rs 55,393 as the problem persisted even after refilling the fuel.However, the dealer passed the buck to the consumer and the service centre. Dealer told the forum that the quality of fuel supplied by them was verified daily and officials of BP used to conduct frequent checks regarding the quality of diesel sold from their outlets.The dealer also accused the service centre of shifting the blame on it by looking away from manufacturing defect. BP refused to receive the notice issued by the forum.During deposition before the forum, the service personnel of the car manufacturer said there was mixing of kerosene with diesel in the sample taken from the fuel tank of the car of the complainant.Meanwhile, the dealer had changed the pump and the diesel tank was dismantled and cleaned.Forum noted that BP, which collected fuel samples from the outlet for examination in their research centre, did not divulge results to the complainant nor to the dealer.The forum imposed fine on BP for unfair trade practice and deficiency in service. The forum also asked the company to give Rs 3,000 to the consumer for cost of proceedings.
