HC dismisses man’s case against in-laws for kidnapping wife

Mumbai: The Bombay High Court has quashed a kidnapping case in which a man had filed an FIR against his in-laws for allegedly kidnapping his wife. When Reshma returned to Mr. Choudhary unharmed on February 7, the HC asked the couple to register their marriage. In his FIR, Mr. Choudhary had alleged that Reshma’s parents had ‘kidnapped’ her on December 17 the same year, as they didn’t approve of the inter-community marriage. Mankhurd resident Mohammad Iqbal Mohammad Umar Choudhary (28) and Reshma, a 23-year-old law student, had eloped and married in July last year. Advocate Hasnain Kazi, representing Mr. Choudhary, said, “As Reshma is Hindu, the court ordered registration under the Special Marriage Act, and directed the Registrar in BKC to waive the one-month waiting period.

The registrar replied saying as the couple had already solemnised the marriage as per islamic law, they could register in their ward.” Mr. Chaudhary’s FIR of kidnapping was cancelled after the couple submitted their marriage certificate to the court. “The court said the FIR was a result of a misunderstanding, and for a peaceful family life, as demanded by Reshma, the FIR is quashed so that her parents aren’t harassed any more,” Mr. Kazi said.
