Mumbai: Court grants bail to youth over consensual relationship

A special Protection of Children from Sexual Offences (POCSO) court last week granted anticipatory bail to a 27-year-old youth who had allegedly gone back on his promise to marry a girl, even after she had given birth to his child. Special judge MA Baraliya granting him pre-arrest bail said in her order, "The important fact to be noted is that the complainant is a literate girl. She was knowing that the accused though promising her, was not marrying with her even before her attempt to commit suicide and even before her conceiving for first time in December, 2016. As the complainant is the well educated lady and keeping relationship with the her own will, knowing probable consequences of keeping such relationship with him, particularly after aborting first pregnancy, so to me, it being the consensual relationship, applicant can be given the relief of anticipatory bail." This time, she refused to abort the foetus though he wanted her to. The woman, now 24, went ahead and had a girl child in February this year. But then, the youth refused to marry her and asked to live with her friend as her parents did not accept her at home. He also refused to maintain her or the child.
