‘Give clients patient hearing, get details for solid court case’

Clients come to a lawyer with an expectation of getting the dispute in what so ever form resolved as they want to get rid of their troubles as early as possible. Such missing links should be put together after the client’s narration is over as those could be of help while pleading the case before a court, he said.In such a situation, a lawyer should get the ambiguity cleared after the client finishes the statement. A lawyer should reassure clients that justice would be done so that much of their burden could be eased, he added.The lawyer should ensure that the client is given top professional help to address the issues he has.

Nagpur: Giving clients a patient ear when they start narrating for what purpose they want to knock the doors of judiciary and getting maximum details of the case are of paramount importance which the budding and practising lawyers should always keep in mind, said advocate Nahush Khubalkar on Wednesday.Delivering a lecture on ‘The skill of taking instruction from the client and drafting pleadings’, organized by High Court Bar Association, Khubalkar said the attitude of a fresh lawyer towards clients should be that of a sympathizer as they come with a problem solution of which is with the judiciary.Khubalkar told four fundamental rules of drafting a plea of stating the facts and not the law, placing material facts, providing evidence and be precise. For this, the lawyer should listen carefully what the client has to say in order to identify the root and nature of his pain, he said.Taking notes when the client takes a pause while speaking is vital. Any interruption can lead to missing some points. Such missing links should be put together after the client’s narration is over as those could be of help while pleading the case before a court, he said.In such a situation, a lawyer should get the ambiguity cleared after the client finishes the statement. Taking signature of the client on the notes after checking facts and knitting loose ends go a long way in the delivery of justice, Khubalkar said.The most important factor before the case reaches the stage of pleading, Khubalkar said, is to build a solid case by cross-checking facts and figures, and telling clients reality of the case.
