NMC, NIT get contempt notice

Nagpur: The state government, Nagpur Municipal Corporation (NMC) and Nagpur Improvement Trust (NIT) have been served contempt notice for the NMC general body’s policy decision to take over 713 regularized layouts (Gunthewari) from the NIT.Advocate Shreerang Bhandarkar on behalf of petitioner Satyavart Dutta has served the contempt notices on February 8. Still, the NMC general body on January 29 passed resolution to take over 713 regularized layouts along with open spaces, PU lands, building sanction powers etc from the NIT. “State agencies have been holding meetings pertaining to handing over the Gunthewari layouts and properties under NIT’s jurisdiction to NMC without prior permission of the Nagpur bench of Bombay High Court. It amounts to contempt of the court and attracts provisions of Section 12 of the Contempt of Court Act, 1971, as well as Article 215 of the Constitution of India,” he said.Dutta through Bhandarkar had filed a PIL against the state cabinet’s decision dated December 27, 2016, to dissolve the NIT. The HC had granted stay on June 13, 2018 and October 10, 2018.
