Security guard handed 3-year jail term for raping minor in Noida

NOIDA: A Pocso court sentenced a 35-year-old man to three years of imprisonment for molesting a 14-year-old girl in 2014 in Sector 24.Chavanpal Bhati, special public prosecutor, said the girl lived with her parents in a rented home. Mukesh, a security guard, grabbed the girl from the area and took her inside his room. There he tried to rapeher. The girl raised the alarm and local people gathered at the spot.They arrested the accused and rescued the girl, he said.The girls father informed police and filed a complaint in this regard. Soon a police team arrested the accused. He was produced in court and sent to judicial custody. A chargesheet was filed against the accused on February 25 that year.The accuseds lawyer, Udayveer Singh, told the court that his client was framed in this case. My client was drunk at the time of incident. He had mistakenly held the girl by her hand and she raised an alarm. He had not tried to rape her, he said.The accused also denied the charges and decided to face trial.The girl told the court that she used to work as a domestic help in a neighbouring house. Mukesh worked there as a security guard. He grabbed me and removed my clothes to rape me. I raised an alarm and local people came and rescued me, she said. Chandra Mohan Shrivastava, special judge (Pocso Act), on Tuesday relied on witness testimonies and convicted Mukesh. He is sentenced to three years jail and fined Rs 5,000 under Section 354 (A) (sexual harassment) of IPC and Section 11/12 of Pocso Act, the court said. The complaint was filed by a senior teacher who alleged that the accused teacher asked students to touch each other inappropriately under the pretext of teaching wrestling. The teachers lawyer argued that the physical engagement in wrestling necessitates such contact. The next hearing is scheduled for November 29th.
