HC orders joint inspection of jails in Himachal

SHIMLA: The Himachal Pradesh high court has stated that all jails in the state would be jointly inspected by the DGP (prisons and correctional services), inspecting sessions judges of the respective jurisdictions and the deputy commissioners within four weeks. It also directed the state government to favourably consider and take action on all proposals that are pending consideration.While hearing the matter on Tuesday, division bench of acting Chief Justice Sanjay Karol and Justice Ajay Mohan Goel found the affidavit filed by the DGP (prisons and correctional services) on August 25 this year to be comprehensively dealing with the issues involved in all these writ petitions.The court also observed that while in certain cases the DGP took action for overcoming deficiencies, certain other remedial measures suggested in the affidavit pertaining to expansion of infrastructure, filling up of posts, providing budget for day-to-day amenities of the jails were pending consideration with the state government.“Noticeably, we find three problems to be acute; (a) health of the inmates, be it on account of lack of infrastructure or over-crowding; (b) lack of clean drinking water, as also sanitation and beddings; and (c) safety of inmates for want of adequate staff,” it observed.The court stated that before it passed any further order, it would be only prudent that all jails in the state were jointly inspected by the DGP (prisons and correctional services), inspecting sessions judges of the respective jurisdiction and the deputy commissioners of respective districts.“Let such inspection(s) be carried out within a period of four weeks and the joint inspection, as also possibly action taken report be filed on or before the next date of hearing under the affidavit of the DGP (prisons and correctional services), Himachal Pradesh.
