Missing Polish trekker: Himachal Pradesh high court summons probe records

Since then he is missing.A division bench of the high court, that included Chief Justice Suryakant and Justice Ajay Mohan Goel, heard the matter on Wednesday. The father of the missing trekker was not satisfied with the police investigation. SHIMLA: In the matter related to the missing of Polish trekker Bruno Muschalik from Parvati Valley of Kullu district , the High Court of Himachal Pradesh has directed the Superintendent of Police (SP), Kullu, to remain present in the Court on the next date of hearing, on November 15, along with the case diary and investigation records. On August 9, 2015 Bruno Muschalik, 24, from Poland had messaged his girlfriend about him leaving for Parvati valley of Kullu district.

SHIMLA: In the matter related to the missing of Polish trekker Bruno Muschalik from Parvati Valley of Kullu district , the High Court of Himachal Pradesh has directed the Superintendent of Police (SP), Kullu, to remain present in the Court on the next date of hearing, on November 15, along with the case diary and investigation records. The father of the missing trekker was not satisfied with the police investigation. On August 9, 2015 Bruno Muschalik, 24, from Poland had messaged his girlfriend about him leaving for Parvati valley of Kullu district. Since then he is missing.A division bench of the high court, that included Chief Justice Suryakant and Justice Ajay Mohan Goel, heard the matter on Wednesday. The Court has gone through three successive status reports filed by SP Kullu, including one dated July 9, 2018. The bench observed that once a prima facie case of commission of a cognizable offence was made out, it was imperative upon the police authorities to register an FIR and, if need be, subject the suspects to custodial interrogation, so as to take the investigation to its logical conclusion.“Unfortunately, the police authorities appear to have indulged in ‘inquiry’ and during such process, certain questions were asked to the suspects as per the assumption and presumption drawn by the SP Kullu, as mentioned in one of her affidavits,” Court added.During the last hearing on August 29, Advocate General Ashok Sharma had stated in the court that if authorized representatives of the petitioner or any representative from the Embassy of the Republic of Poland were to meet SP Kullu, furnishing additional information with regard to the alleged crime, further investigation shall be carried out expeditiously, in accordance with law.Vandana Misra, counsel, under instructions from Jakob Zaczek II Secretary, Embassy of Poland, stated that authorized representative of the Embassy would meet SP Kullu, in her office within next four weeks.On which, Court had directed that supplementary affidavit with regard to further investigation, if any, carried out in the matter, be filed by SP Kullu. “Also, she shall file an affidavit placing on record the outcome of the notices issued to the officers of the department,” Court had said.“Independent to the investigation so conducted thus far and considering the fact that the petitioner’s son namely Bruno Mushalik, is a foreign national and that his matter has been constantly pursued by the Embassy concerned as also by an independent agency, for ascertaining his whereabouts, in the interest of justice, we direct that the matter regarding missing and any other alleged aspects be investigated afresh by an officer not below the rank of Deputy Superintendent of Police of the CID Crime, Shimla, “ Court had observed in an order issued on July 20 last year.
