Love jihad case: Notice to police on allegations of ‘submitting false status report’

CHANDIGARH: The Chandigarh district court issued a notice to Chandigarh Police on Wednesday after the defence moved an application alleging that it (UT police) submitted a false status report in the ‘love jihad’ case, in which an underage Srinagar resident has been charged for criminal intimidation and rape of Chandigarh-based girl. The court also sought a reply on an application moved by the defense counsel to register a case against sub inspector Upwinder Singh in case.The court had sought status report from police on the complainant’s age, acid attack and rape.

CHANDIGARH: The Chandigarh district court issued a notice to Chandigarh Police on Wednesday after the defence moved an application alleging that it (UT police) submitted a false status report in the ‘love jihad’ case, in which an underage Srinagar resident has been charged for criminal intimidation and rape of Chandigarh-based girl. The court also sought a reply on an application moved by the defense counsel to register a case against sub inspector Upwinder Singh in case.The court had sought status report from police on the complainant’s age, acid attack and rape. Cops submitted the report on Wednesday, stating that the accused was trying to “save his skin”. The defence alleged that the police officer submitted the status report without conducting fair investigation.The matter will come up for hearing on October 9.Defence counsel Terminder Singh moved an application against SI Singh, of Sector 34 police station, who submitted the report, alleging that it was “false” and no investigation had been conducted. He stated that the police report was filed without recording the statement of the girl or verifying any document.Earlier, the accused had moved a cross-complaint against the girl, seeking a case against her under relevant sections of the POCSO Act and the Information Technology (IT) Act for “following and communicating with the child through Facebook, phone etc and threatening him and his parents by various means”. He also alleged that the victim had falsely claimed to be 17 and hence a minor in her complaint, whereas no birth of certificate could prove the same.According to her compliant, the accused befriended her on Facebook in January 2016. In November, they both met when the accused came to Chandigarh and the girl got to know that he was a Muslim. She further alleged that they again met in April 2017, when the accused forced her into a physical relationship and took objectionable pictures. She alleged that she was forced to convert to Islam. Later in the year, she went to Srinagar where she was raped by five members of his family, she alleged.On June 4 this year, she alleged an acid attack on her while going to a juvenile court. But doctors found no such injury on her. The girl had moved the HC, demanding other investigation agencies to investigate this case. The HC had send the matter to trial court whereby the charges were framed against the accused and the trial court had issued warrants against the girl for not appearing in court to record her statement .
