LG approves prosecution of two police officials in forgery, embezzlement case

Delhi Lieutenant Governor Vinai Kumar Saxena has approved the prosecution of two police personnel, Head Constable Rakesh Sharma and Constable Khushi Ram, in connection with a case involving embezzlement and forgery. The case is based on an FIR filed in 2018 by the Economic Offences Wing (EOW) of Delhi Police. The FIR, registered on May 14, 2018, was filed under serious sections of the Indian Penal Code, including cheating, criminal breach of trust, forgery, and destruction of evidence. It also includes charges under the Information Technology Act. The case came to light after an internal investigation was carried out by the Licensing Unit of Delhi Police. The probe revealed irregularities in the collection of Government fees related to the issuance and renewal of licenses for arms, eating houses, hotels, CPLs, and press registrations. According to the investigation, instead of giving system-generated official receipts, the accused officers issued fake cash receipts to applicants. These fake receipts were not recorded in the official system, and the money collected was never deposited with the Government. This resulted in financial loss to the exchequer. Investigators also found that some files had been deleted from official computers, and important documents were missing. The forgery reportedly took place between September 1, 2016, and February 20, 2018. Most of the fake receipts were issued at Arms License Renewal Counter number two, which was being handled by Head Constable Rakesh Sharma during the period from March 2017 to February 2018. Despite other counters being available, the majority of such transactions occurred at his counter, raising suspicion of planned fraud. The investigation also pointed to Constable Khushi Ram, who worked as a cashier, being involved in the conspiracy. It was found that both officers used a fake receipt format and the same printer used for official receipts, bypassing the proper software system used for collecting Government fees. Forensic reports and the charge sheet filed by the EOW confirmed the involvement of both officers. After reviewing the evidence, the Home Department of the Delhi Government also supported the decision to prosecute. While approving the sanction under Section 197 of the CrPC, the LG has also directed the Home Department to revisit Delhi Polices request for another prosecution sanction under Section 140 of the Delhi Police Act, 1978. In addition to the criminal proceedings, the possibility of departmental action against the two officers is also being considered. This case highlights the importance of internal checks within Government departments and the need for strict action against misuse of authority.
