Tribunal orders 36L compensation for family of biker who died in crash

Gurgaon: A tribunal on Monday ordered that compensation of Rs 36 lakh should be paid to the family of a 30-year-old biker who died after he was hit by a car being driven on the wrong side of the road in May 2022.The compensation will have to be paid by the insurance company of the car driver Tej Singh, Sunil Kumar Dewan, presiding officer of the Motor Accident Claims Tribunal-Gurgaon, said in this order.On May 17 last year, Pradeep – a supervisor at a logistics company in Pataudi – was on his way to work when the car driven and owned by Tej Singh rammed into him. The biker was rushed to the Civil Hospital in the city, where he succumbed to his injuries. Pradeep was the only earning member of his family. He is survived by his wife, three children and parents. Rampur villager Vikas witnessed the accident and had noted down details of the car. Based on this information, cops registered a case at the Pataudi police station under section 279 (rash driving) and 304A (death by negligence) of the IPC.During the hearings, Singh said in a submission to the tribunal that he was not at fault and the allegation against him was made to get compensation. Singhs insurance company also argued that they were not liable to pay compensation as their client did not have a valid driving licence at the time of the crash, and neither did his vehicle have a valid fitness certificate. Dewan, in the order, observed that registration of an FIR and trial of the accused in a criminal court were sufficient evidence to arrive at the conclusion that the accident had taken place. The eyewitness statement and police investigation prove that the accident was caused by vehicle driver due to rash and negligent driving, it said.The tribunal then awarded compensation of Rs 36 lakh along with interest at the rate of 7.5% per annum. The decision was upheld by the National Consumer Disputes Redressal Commission.Punjab & Haryana HC sets Rs 10,000 compensation for dog bite victimsThe Punjab and Haryana high court has ruled that the state government will be responsible for compensating victims of dog bites. The court stated that the minimum compensation would be 10,000 ($135) per tooth mark and 20,000 ($270) per 0.2 cm wound. The ruling also mandates the governments of Punjab, Haryana, and the Union Territory of Chandigarh to set up committees to determine the compensation. This ruling is significant as dog bite cases have been increasing across the country, with Ghaziabad reporting 70-80 incidents daily.
