Youth, lone breadwinner, dies as auto turns turtle, parents get ₹25L damages

Gurgaon: The parents of a 26-year-old man, who died after the auto-rickshaw he was overturned in January this year, have been awarded a compensation of Rs 25 lakh by the Motor Accidents Claim Tribunal (MACT) in Gurgaon. Amarjeet was on his way to his workplace in Manesar from his home in Bhangrola in a shared auto-rickshaw when it turned turtle in Sector 6 on January 30, 2023.He was severely injured and died on the way to ESI Hospital in Manesar.An FIR was registered at Manesar Sector 7 police station the same day under sections 279 (rash driving) and 304A (causing death by negligence) of the IPC. The compensation claim was filed by the victims father Ram Karan and his wife Shiyakali against auto driver Sunny, its owner Vikas Kumar and a private insurance firm.Ajay Pal, the counsel for the petitioner, said Amarjeet was a healthy 26-year-old man working with a private company and had a monthly salary of Rs 25,675 per month. His parents were dependent on his earnings. With his sudden death, they have lost their sole breadwinner and are entitled to compensation, Pal said.Shubham Raj Shrivastav, counsel for the accused, argued that the petitioners concealed the true material facts from the tribunal and denied their role in the accident. But they claimed to have valid insurance and argued that the insurance company is liable for the compensation.Himanshu Gambhir, counsel for the insurance company, said the petition was filed with malafide intentions and raised questions over Amarjeets salary.Additional sessions judge Surya Pratap Singh of MACT observed that FIR has specific details of the driver, along with his mobile number. The facts presented show that the deceased and his other colleagues used to travel daily in the said auto-rickshaw and a deliberate attempt was made to change the identity of the driver who was driving it at the time of the accident, the tribunal said.The parents are to be awarded compensation under the loss of consortium on the death of a child, and the amount awarded to the parents is a compensation for loss of the love, affection, care and companionship of the deceased child. Father and mother are entitled for final consortium, it said in an order dated December 1, awarding a compensation of Rs 25 lakh to Amarjeets parents.
