Non-bailable warrant issued against Improvement Trust Chairman

NON-COMPLIANCE OF ORDERSAvneet KaurJalandhar, November 21The District Consumer Disputes Redressal Forum has issued a non-bailable warrant (NBW) against the Chairman of the Jalandhar Improvement Trust (JIT) over the non-compliance of its two-year-old orders related to a complaint filed by an allottee, Chander Kanta, of the Bibi Bhani Complex. Karnail Singh, president of the forum, and Jyotsna, a member, on Monday issued the orders of the arrest warrant of the Chairman through the Commissioner of Police for December 17. However, sick of the ignorant attitude of the authorities concerned, she filed the case in the consumer forum in 2017. Darshan Ahuja, president, Bibi Bhani Residential Welfare Association, while talking to The Tribune said 15 cases filed by the JIT in the State Commission had been dismissed. He said on the pretext to delay the payments of the allottee, the JIT was approaching the State Commission.

Karnail Singh, president of the forum, and Jyotsna, a member, on Monday issued the orders of the arrest warrant of the Chairman through the Commissioner of Police for December 17. The orders were issued after the forum found that its orders regarding the refund of an amount of Rs 5.27 lakh with 12 per cent interest from July 2012, till realisation along with Rs 37,000 as compensation and litigation expenses to an allottee of the scheme had not been complied with. The case pertains to a complaint filed by Chander Kanta of Bhagwan Dass Pura in June 2017 over the failure in the delivery of possession of LIG flat no. 86 in the 51.5-acre scheme at Guru Amar Das Nagar. The plaintiff said she had got the allotment in a lucky draw in August 2009 and had paid the purchase price of Rs 5.27 lakh. She said she was told that the JIT would give the possession of the flat by July 2012. But, it did not deliver the possession of the flat on time. She said she waited for the possession till 2016 and made several requests to JIT officials. However, sick of the ignorant attitude of the authorities concerned, she filed the case in the consumer forum in 2017. Chander Kanta said as per the forum orders, the JIT was to pay her the principal amount along with 12 per cent interest by June 2019, but the Trust instead of following the forum orders approached the State Commission to seek some relief in the interest rate. However, dismissing the JIT appeal, the state commission ordered the Trust to compliance with the forum orders and make the payment to the allottee by August 9 along with an additional compensation of Rs 25,000. Darshan Ahuja, president, Bibi Bhani Residential Welfare Association, while talking to The Tribune said 15 cases filed by the JIT in the State Commission had been dismissed. He said on the pretext to delay the payments of the allottee, the JIT was approaching the State Commission. He alleged that poor quality material had been used by the JIT in constructing the apartments. While there was no provision of street lights, sewerage, electricity and water in the area so far. The JIT had failed to comply with the orders of the forum in many cases and had not given compensation to the allottees who had won cases recently.
