Victim turns hostile, court orders action

AGRA: A local court in Muzaffarnagar ordered the filing of a case against a victim of the Muzaffarnagar riots in 2013 after he turned hostile.Akhtar, a resident of Phugana village, claimed that around 2pm on September 8, 2013, a group of rioters armed with pistols, guns, lathis and an axe forcibly entered his house to kill him and his family members. Akhtar also claimed he and his family sustained severe injuries and their house was ransacked, with jewellery, clothing, furniture, and valuables looted and destroyed. The assailants set the house ablaze, forcing him and his family to seek shelter at a refugee camp in Jola village. A case was registered at Phugana police station against six individuals -- Kapil, Sachin, Jitendra, Yogesh Vikas, and Vinod - and several unidentified miscreants under various IPC sections including 147 (rioting), 307 (attempt to murder), and 153A (promoting enmity between different groups). The trial was conducted in Court 15 of the additional district and session judge. However, in court, Akhtar said no such incident took place, leading to the acquittal of the six accused. He claimed that when communal riots erupted in his village, he and his family left their home with all their valuables and sought refuge in a relief camp in Jola village. He asserted that there was no harm to his family or property, and he was unaware of the case against the six accused. He also disclosed that after leaving the village, a few individuals approached him and obtained his signature on a blank page, ostensibly luring him with promises of compensation. The contents of the page remained a mystery to him. The court, in its order, said, "A suit against Akhtar under Section 344 CrPC should be registered, and notice should be issued against him."
