Order to slap Rs 10k fine daily in unregistered madrasas withdrawn

Agra: In a quick volte-face, the Muzaffarnagar district education department on Wednesday decided to withdraw its order to slap a fine of Rs 10,000 a day on undocumented madrassas after the districts minority welfare department and the Uttar Pradesh Madrassas Board objected to the decision. The U-turn comes days after TOI reported that the education departments block education officer (BEO) had recently issued notices to several madrassas to produce a registration certificate or shut the madrassa, failing which they would have to pay the amount.Speaking to the media on Wednesday, a Basic Shiksha Adhikari (BSA) said the notice will not apply to madrassas, but to schools being operated without proper documents.Maithili Rastogi, a minority welfare officer in Muzaffarnagar, said, "It came to my knowledge that several notices were issued to madrassas by the BEO in Purkazi. However, as per the rules of the Right to Education (RTE) Act, which were amended in 2012, madrassas and Vedic schools do not come under BSA. Only the Madrasa Education Officer has the jurisdiction to issue such notices and inspect madrassas. The BEO, perhaps, was not aware of this. I will write to the BSA to withdraw the notices." Meanwhile, UP Madrassa Board Chairman Iftikhar Ahmed Javed issued a statement in Lucknow saying, "No one barring the minority welfare department has the right to interfere in matters related to madrassas. The education department can impose penalties or fines on schools, but not on madrassas. Madrasas are not schools. In 1995, madrassas were separated from the schools rules and regulations and the education department meddling with madrassas affairs is not fair."BSA Subham Sukla agreed, saying, "Madrassas do not come under the BSA office and the notices will not apply to them. However, schools that are operating without registration with the education department will have to comply with the notice."
