Nod to salary settlement deal for Bajaj workers

Chhatrapati Sambhajinagar: An industrial tribunal at Aurangabad has passed an award in favour of a memorandum of settlement signed between the Bajaj Auto Limited at Waluj and members of the Bharatiya Kamgar Kranti Sanghatana (BKKS) resolving a long pending dispute over the salaries to 1,017 temporary workers, who removed from service over two decades back.The agreement between the two disputing parties ends a long-standing litigation, which had gone up to the Supreme Court at different points in time. Aurangabads deputy labour commissioner had made a Reference to the industrial tribunal after the failure of a conciliation proceeding between the disputing parties.On October 11, BKKS leader Dada Jadhav had filed a settlement proposal before the industrial tribunal on the lines of an Apex court ruling of 2013 in Bajaj Auto vs Rajendra Kumar Jagannath Kathar. In that case, the SC had ruled that the appellant (Bajaj Auto) is directed to pay lump sum amount calculated at 65 days salary, inclusive of all allowances, for the number of years each complainant has actually worked irrespective of the days a complainant may have put in in a year.Bajaj Auto accepted the settlement proposal and agreed to pay a lump sum amount of Rs13.31 crore to the 1,017 ex-temporary workers mentioned in Annexure A-I of the proposal.Industrial tribunals presiding officer S S Maudekar said in the award passed on November 8 that the workmen whose names are mentioned in Annexure A-I have agreed to receive a lump sum amount calculated at 65 days salary inclusive of all allowances. I have also gone through the said (SC) judgment. The details of the amount payable to the workmen are given in the last column.Even the parties agreed that if some of the workmen have died during the pendency of the Reference, the first party (Bajaj Auto) would pay compensation to their legal heirs. So, the award will be final and not interim so far as their claim is concerned, the award stated.Lawyer Sachin Dankh, who represented Bajaj Auto, told TOI, The award has been passed finally to the extent of ex-temporary employees named in Annexure A-1 to the settlement. The payment shall be disbursed as per the terms of settlement.Lawyer Sandeep Rajebhosale, who represented the workers, told TOI, The company had temporarily appointed a total of 1,525 as fitter, welder, turner, mechanic and grinder, among others, in 1980s and 1990s for a period of seven months.He added, These workmen were given artificial breaks, even though the work was available in the company, which followed the rotation of workmen. A batch of 1,197 workmen filed the first round of litigation before the industrial tribunal demanding salaries and regularization of their appointment and this set off the prolonged litigation process.
