Man sentenced to three-year RI for stalking minor

He threatened her by saying that if she refused marriage, he would throw acid on her face. Since he has already passed 443 days in jail, time will be adjusted with the sentence. When the girl said she would tell her father and brother know about his activities, the accused threatened to kill her brother as well.The minor narrated the incident to her father, who took her to the police station and lodged a complaint.

BHOPAL: The court of additional district & sessions judge, Kumudini Patel, on Tuesday sentenced a person to three years of rigorous imprisonment and slapped a fine of Rs 2,000 for stalking and intimidating a minor girl under Section 354 of the Indian Penal Code and Protection of Children from Sexual Offences ( POCSO ) Act.According to the prosecution, a Class 9 student accompanied by her father came to Tila Jamalpura police station on September 24, 2013, and lodged a complaint against Kamal Panthi, (29). They accused him of stalking since a few days, while she was on her way to school.On that day, when the minor girl asked him not to follow her, he caught hold of her hand and told that she wanted to marry her. He threatened her by saying that if she refused marriage, he would throw acid on her face. When the girl said she would tell her father and brother know about his activities, the accused threatened to kill her brother as well.The minor narrated the incident to her father, who took her to the police station and lodged a complaint. Cops after registering a case under Section 354 of the IPC and relevant sections of POCSO Act, investigated the case and arrested the accused after they found prima facie evidence of his involvement in the crime.The court of Kumudini Patel held the accused guilty under all the sections and sentenced him to 3 years of rigorous imprisonment and Rs2,000 fine. He will have to remain in jail for another year, if he fails to pay the fine amount. Since he has already passed 443 days in jail, time will be adjusted with the sentence.
