HC imposes `1L cost on IMC

Indore: Indore bench of MP high court imposed cost of Rs one lakh on IMC payable to petitioner for misusing its power to arbitrarily terminate him from his service to save its image in public.Justice Vivek Rusia while imposing cost quashed petitioners termination order directing IMC to reinstate petitioner Mehfooz Khan into the service with full back wages and all consequential benefits.The court expressed shock at IMC working and stated, This court is shocked and surprised that in Municipal Corporation, Indore, the work of preparation of charge and imputation of charges are being handled by Beldar or in-charge clerk.Khan was terminated from service on June 22 last year on account of alleged misconduct in framing charges against one Mohammad Aslam Khan, who was trapped in a case of disproportionate assets by Lokayukta in August 2018.The IMC was undertaking a departmental inquiry against Aslam. While the pending DE was on, IMC reinstated Aslam, the corporation terminated Beldar alleging misconduct on his behalf for not framing charges and imputations of charges against Aslam.Interestingly, petitioner Khan was posted to EOW and Lokayuta establishment in July 2019 as an in-charge clerk there. He appealed against his termination before IMC on September 29, last year but it was also dismissed. He later moved to the high court against the termination order.The court observed, If the matter of Mohammed Aslam Khan was so serious, the then Commissioner ought to have directed the subordinate officer to call the file and prepare a note-sheet. The Corporation itself took the decision to reinstate Mohammed Aslam Khan into the service and he is in service this petitioner has been blamed for it to save the image in public, therefore, the entire action of removal of this petitioner is illegal, a misuse of power, arbitrary and liable to be condemned with strong words.We also published the following articles recentlyDam reports contradictory, bid to mislead NGT: PetitionersPetitioners in Bhopal have accused a joint committee of making false claims in a report to the National Green Tribunal (NGT) regarding the removal of encroachments near two dams. The petitioners are demanding an investigation into the matter and appropriate punishment for the committee members involved.High court imposes Rs 10,000 cost on ADM for habitual arbitrary exercise of power In SARFAESI ActThe Indore bench of the Madhya Pradesh High Court has imposed a fine of Rs 10,000 on ADM Sapna M Lovanshi for wasting the courts time by assuming the role of an adjudicatory authority. The court stated that Lovanshi had gone beyond her jurisdiction by dismissing an application under the SARFAESI Act. The court warned that in the future, Lovanshi should follow the orders passed by the High Court and the Apex Court and not interpret them on her own.Cipher case: Imran Khan moves high court against his hasty indictmentFormer Pakistani Prime Minister Imran Khan has filed a petition in the Islamabad High Court, challenging his indictment by a special court on charges of leaking state secrets and violating the countrys laws. Khan argues that there was a rush in framing charges and that the judge committed a gross illegality by doing so in the absence of key evidence. Khan and his ally Shah Mahmood Qureshi face the possibility of a death sentence. Khan was arrested in August on charges of violating the Official Secrets Act. More than 150 cases have been registered against him since his ouster from power in April 2022.
