Man gets 7yr jail for abducting and raping minor

Kanpur: Additional district and sessions judge/FTC (special court for offences against women) Shailendra Kumar on Monday sentenced accused Babu Khan alias Sajjad, a resident of Jhari Baba ka Padao in Cantonment to seven years rigorous imprisonment along with a fine of Rs 16000 for enticing, kidnapping, and physically exploiting a minor girl.The court ordered 75 percent (Rs12,000) be paid to the victim as per law. The accused has to undergo another three months term in jail if he fails to pay the fine amount, the court observed in its order.According to ADGC Omendra Dixit, on the point of quantum of sentence the defence counsel pleaded that since the accused was the only bread and butter earner in the family consisting of his mother, wife and children, therefore the court should take a lenient view. While the prosecution demanded strict punishment to the accused as he had committed a crime against a woman. The victims father in his complaint claimed that accused Babu Khan had kidnapped his minor girl around 4 pm. on August 17, 2011, and the police recovered her on August 23, 2011.The victim in her statement stated that Babu Khan had enticed, kidnapped him and took her to Lucknow and Delhi where he repeatedly exploited her physically. The businessmen had filed an application before the special PMLA court stating that they have moved the Supreme Court for bail, but the court rejected their application and issued arrest warrants. The three accused are currently out on bail on medical grounds. The Chhattisgarh high court had also rejected their bail application. The ED had arrested them under the Prevention of Money Laundering Act.
