Kanpur: The MP/MLA court on Saturday pronounced its reserved order against Samajwadi Party MLA Irfan Solanki, Rizwan Solanki and others in the arson case. MP/MLA court judge Satyendra Nath Tripathi, who is also additional session judge, allowed the application of the accused application by which they had urged to summon their call detail and location reports of the date of incident.However, the court, while dismissing the plea of other accused for summoning their call detail and location reports, has fixed December 7 as the next date. The accused had urged the court to summon the call detail and location reports of Aqil Ahmad, Naseem Arif and Kaneez Zohra, daughter of Nazir Fatima. The court had reserved the order on the previous date. Irfan Solanki, who was summoned from Maharajganj jail, appeared before the court on Saturday along with four other co-accused. The court heard applications of Irfan and Rizwan Solanki in compliance with the directions passed by the Allahabad high court recently.The high court on submissions of Solanki brothers had directed the MP/MLA court to rehear their applications. The accused pleaded before the high court that they had preferred an application before the trial court to seek the call detail and location reports of the alleged accused but the court refused to summon them. CDR and location reports were necessary for fair justice, they had argued. Defence counsel Saeed Naqvi argued before the court on Tuesday that as both the CDR and location reports were necessary for the trial, therefore, the court should summon them. Countering it, ADGC Bhaskar Mishra submitted that there was no need to summon both the reports as three prosecution witnesses had already mentioned in their examination-in-chief and cross-examination that Irfan and Rizwan were not carrying their mobile phones at the arson site. Moreover, one defence witness Shubham Gupta too had admitted in his examination-in-chief that Irfan and Rizwan were not carrying their phones at the arson site, therefore, there was no need to summon them and the accuseds application was liable to be dismissed. The court, after hearing the arguments of defence and prosecution, had reserved its order.
