Cantt SHO booked for disobeying court order

Kanpur: Incharge of the Cantonment police station was booked for inordinate delay in registering an FIR in a four-wheeler theft case.The incharge was booked following order of the Allahabad High Court, directing commissioner of police (CP), Kanpur Nagar and station house officer (SHO), Cantonment, Ajay Kumar Singh to appear before the court in person to explain the reason for not complying with a lower courts order passed about three months ago.On August 1, 2023, a car belonging to advocate Ravikant Uttam, a resident of Dalpatpur in Prempur, was stolen from the Cantonment area. According to Ravikant, the theft had taken place while he was returning home from the district court on August 1, 2023. At around 7.30 pm, the advocates car developed some snag near the PAC turn at the GT Road in Chandmari area. He parked the car there and went to his office in the Fazalganj area. However, when he returned, he found his car missing.Later, on August 2, at around 1.06 am, when a message regarding toll tax deduction came on his mobile, he came to know the location of the car which was in Panipat Haryana. Subsequently, he reached the Chakeri police station with a complaint, but the policemen on duty allegedly refused to file a case. On August 3, Ravikant then submitted a written complaint with the commissioner of police, but in vain. Ravikant filed an application to register a case in Kanpur court on August 19. The spot from where the car was stolen came under the Cantt police station.Hearing the plea, Justice Saurabh Srivastava passed an order on September 2, directing the SHO to lodge an FIR. However no FIR was lodged. The matter was then raised before the Allahabad High Court, which asked the commissioner of police and the SHO to appear in person before the court on December 7 and explain why action should not be taken against them.Taking cognizance of the issue, commissioner of police RK Swarnkar instituted an inquiry against SHO Ajay Kumar Singh and also directed to book a case as per the law. Subsequently, on Wednesday an FIR against SHO under Section 166 A of IPC (Public servant disobeying direction of the law) was lodged with the Cantt police station. He submitted the Allahabad High Court order that stayed his arrest till December 5. The chargesheet against Diwakar has not been filed in the Kanpur court yet. The court clerk will send the application, affidavit, and order of the high court to the police for necessary proceedings. Defence counsel presented the HC order and related papers in the Kanpur court.High court directs tourism dept to register cruise vessel within a weekThe high court of Bombay at Goa has directed the tourism department to register the cruise vessel of Celestial Cruises and Hospitality LLP within a week. The company approached the court after the tourism department rejected the registration under the Goa Registration of Tourist Trade Act, 1982. The court considered the May 9, 2022, order banning new licences and the July 17, 2023, modification excluding certain water sports activities. Deep Shirodkar, representing the tourism department, agreed that the cruise vessel wouldnt cause congestion. The court directed the registration, set aside the November 8, 2023, communication, and stated no point in remanding the matter.
