HC dismisses Traffic Ramaswamy’s petition

  • | Wednesday | 23rd August, 2017

The Madurai Bench of the Madras High Court on Tuesday dismissed activist ‘Traffic’ Ramaswamy’s petition seeking the dismissal of the State government, which he alleged was corrupt, by the Governor. The Governor has powers only when the confidence of the majority is lost. The petition was dismissed without costs. The court observed that the Governor, though has the power to summon the House, has no overriding authority over the representatives of the State Legislature when the Chief Minister and the Council of Ministers enjoy the confidence of the majority of the House. On the contention of the petitioner that a full-time Governor should be appointed for Tamil Nadu, the court observed that though it was genuine, the petitioner had not made any representation to the Central government and without submitting representations to the concerned authorities it was not possible to issue directions in the issue.
