Activistrsquos case against bank closed months after his death

At the end of 12 months the bank credited interest amount of Rs 5,240 in his recurring deposit account.Later, in December 2012 Desai had closed the recurring deposit account and asked the bank to transfer the amount to his savings bank account. The bank started debiting the money in April 2011 till March 2012. The court while passing its final order stated that it learnt through newspapers about the passing away of Desai.“In the larger interest of justice the case is disposed since the heirs of the complainant have also not come forward,” the court observed. Since the recurring deposit account is not renewed automatically like fixes deposit account, Desai did not receive any interest for the period between March and December 2012.He moved the consumer court claiming that he was under the impression that his recurring bank deposit too would be renewed like fixed deposit account and he will get the benefit for the period from March to December 2012. Desai had informed the court that he was not aware that the recurring deposit is not renewed since the bank did not provide him with any rule book or passbook and bank did not make him aware of non-renewal.The arguments in the case went on for four months, but after he passed away nobody remained present in the court for hearing as he used to fight his cases on his own. The court while passing its final order stated that it learnt through newspapers about the passing away of Desai.“In the larger interest of justice the case is disposed since the heirs of the complainant have also not come forward,” the court observed.
