Court defers hearing in Gyanvapi case to Nov 29

Varanasi: The court of district judge on Friday deferred the hearing on the plea of advocate Vijay Shankar Rastogi for making him a party in the civil suit filed by head priest of Acharya Ved Vyas Peeth temple, Shailendra Kumar Pathak Vyas, seeking the appointment of a receiver for the cellar (Tehkhana) on the southern side of Gyanvapi mosque.Vyass advocate Subhash Nandan Chaturvedi said that no hearing could take place as lawyers had stayed away from legal work following a condolence meeting.The court fixed November 29 as the next date of hearing. Chaturvedi said that Vyas had already filed his objection against the plea moved by Rastogi to become a party in this case by appearing before the court personally on November 20. Rastogi is already contesting a case number 610/1991 as next friend of Swayambhu Jyotirlinga Bhagwan Vishweshwar seeking removal of the Gyanvapi mosque from the Adi Vishweshwar temple land. The disposal of this case is pending before the Allahabad high court.Vyas had filed his suit before the court of civil judge senior division on September 25, while an application was also moved before the court of district judge to get this suit transferred to his court. The district judge had allowed the transfer on October 16. Apart from demanding the appointment of a receiver, Vyas has also sought to direct the receiver to allow the plaintiff, co-pujaris, nominees of Shri Kashi Vishwanath Trust board and the devotees to perform puja and rituals within the cellar (Tehkhana) in the old temple of Lord Adi Vishweshwar after making suitable provisions with appropriate changes in the iron fencing for the purpose within the time provided by the court.The court of the district judge on November 8 reserved its order on the suit after the completion of arguments of the plaintiff and defendant Anjuman Intezamia Masjid (Gyanvapi mosque management committee).We also published the following articles recentlyNext cellar suit hearing on November 20The Varanasi district court has scheduled a hearing on November 20 for a plea filed by advocate Vijay Shankar Rastogi. The SC collegium emphasized Sundaresans competence, merit, integrity, and specialization in commercial law, making him an asset to the Bombay High Court.Gyanvapi case: Contest shivling report at trial, Supreme Court tells Muslim partyThe Supreme Court suggested that the Gynavapi mosque management committee challenge the evidentiary value of the Varanasi court commissioners report, which mentioned a Shivling in the mosques wuzu area. The committee objected, claiming the appointment of the court commissioner was illegal. The court suggested cross-examining the commissioner during the trial and challenging the value of the report. The committee also sought a decision from the Supreme Court on the appointment of the commissioner, carbon dating of the Shivling, and the maintainability of the suit under the Places of Worship Act. The court extended its interim orders protecting the wuzu area in the mosque and scheduled further hearing for December 1.
