Cellar case: Next hearing on Saturday

Varanasi: District Judge Ajay Krishna Vishvesha on Thursday started hearing on the plea of advocate Vijay Shankar Rastogi seeking to become a party in the civil suit filed by head priest of Acharya Ved Vyas Peeth temple Shailendra Kumar Pathak Vyas to seek appointment of receiver of the cellar (tahkhana) in the southern side of Gyanvapi mosque.Special government counsel for Gyanvapi cases Rajesh Mishra said that following initial argument by Rastogi in support of his demand the courtfixed the next hearing on his application on Saturday.Regarding the points of his argument Rastogi said that during his argument he mentioned the same facts which were given in counter reply against the objection filed by Vyas against his move. In his counter reply Rastogi had mentioned that in his suit Vyas has admitted that the property in question belongs to Swayambhu Bhagwan Visheshwar and as he is already contesting suit number 610/1991 as next friend of deity hence no one can claim on this property by filing a suit without making him a party in it. Vyas had filed his suit in September and hearing on it started at the court of district judge and after the completion of arguments of plaintiff and defendant Anjuman Intejamia Masajid (Gyanvapi mosque management committee) it had reserved its order on November 8. On the same day Rastogi filed his plea to become a party in this suit. Vyas filed his objection against the plea moved by Rastogi after which the latter had filed his counter reply on November 21. The order is expected to be delivered on Thursday. The court also fixes Thursday for hearing the plea of advocate Vijay Shankar Rastogi to be made a party in the suit filed by head priest of Acharya Ved Vyas Peeth temple. Arguments of plaintiff and defendant completed, court reserved its order on November 8. Rastogi filed his plea to become a party the same day.
